In August of 2008 Denver County Colorado voters added several provisions to the Colorado vehicle impoundment law. The 2008 provisions allow the vehicles of illegal aliens or those drivers reasonable suspected to be an illegal alien to be impounded. Police officers were also given the discretion to issue a summons without impounding a vehicle for those caught driving without a valid license if the driver could present corroborating identification and proof of a valid license within three working days to a Denver County Court.
Furthermore, vehicles that were impounded could be released if the driver posted a $2,500 bond within 30 days of the impoundment. However, drivers that can show proof of a valid license are only required to pay towing and impoundment charges. The $2,500 bond shall be forfeited if the vehicle is operated by an unlicensed driver within one year of the automobiles release.
On November 3rd Denver County Voters can amend the impoundment provision by allowing officers the discretion to issue a summons without the immediate impoundment of a vehicle for drivers that do not have a valid license in their immediate possession but have proof of insurance on the vehicle and another form of identification. Furthermore, voters must decide if bond exemptions should be allowed for rental cars, stolen vehicles, expired licenses renewed within 20 days, and lien holders when vehicles were sold to a validly licensed driver?
