The state of Illinois has hardened their stance on first time Driving Under the Influence offenders. Illinois has passed legislation that requires first time DUI offenders to equip their vehicles with a device that detects alcohol on their breath.
Under the former Illinois law a first-time offender was given a three-month suspension of their driver’s license for a failed breath-analysis test, or a six-month suspension for refusing to take the breath test.
The new legislation suspends the license of a first time offender with a blood-alcohol concentration of 0.08 percent or higher for six-months. Drivers that refuse to undergo the breath analysis will have their license suspended for one year.
In addition to doubling the amount of time a driver’s license shall be suspended; the legislation requires a first time offender to have a Breath Alcohol Ignition Interlock Device equipped to their vehicle. The Ignition Interlock device allows drivers only to use their vehicle when a breath sample is given. The breath sample must produce an alcohol content below 0.025 percent, or the vehicle will not start.
Furthermore, all interlocking devices must be installed by a business that has been approved by the Illinois Secretary of State’s Office. Offenders are responsible for paying to have the device installed, certified each month and removed upon completion of sentence.
The driver’s license shall be suspended 46 days after the arrest or testing date, except in cases in which the driver submitted to a blood or urine test. Drivers that had a blood or urine test shall have their license suspended 46 days after the lab analysis is completed.
